    I can't cancel the order because the seller has to cancel the order

    You can cancel the order.

    In the drop-down menu go to "buyer cancel order".

    I have now just waiting for refund it says pending and has been saying pending for a couple of days now

    Please don't open multiple tickets over the same issue. This is a middleman protected transaction and your cancellation is pending. Meanwhile, we closed the sellers account since they didn't even bother responding. Deadbeat sellers don't belong here.
